These Terms of Service apply to the Shelly mobile application (package: com.shelly.shelly), published on Google Play by Shelly team.
1. Acceptance of Terms
By downloading, installing, or using Shelly ("App"), you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Description of Service
Shelly is a personal companion for recording and keeping memories of marine life adventures. It helps you document fish species, catches, sightings, locations, dates, photos, and notes from your trips. Features include:
- Personal marine life and fishing logs
- Species, catch, and sighting records
- Location and date/time tagging (optional)
- Photo memories and trip notes
- Adventure history and discovery insights
- Optional cloud backup and sync
3. Marine Safety, Fishing & Legal Disclaimer
- Shelly is NOT a navigation, weather, safety, emergency, or professional fishing service.
- Do not rely on Shelly for navigation, weather decisions, sea safety, or emergency communication.
- Always follow local fishing laws, licenses, catch limits, protected species rules, and marine conservation regulations.
- Sea and weather conditions can change quickly. Use caution and proper safety equipment.
- In case of emergency, contact your local emergency services, coast guard, or maritime authorities immediately.
4. User Accounts and Data
- You are responsible for maintaining the confidentiality of your account credentials.
- Provide accurate information during registration (optional).
- You own your adventure data: logs, fish records, photos, notes, locations, and memories.
- Data is stored locally and may be optionally backed up to secure cloud storage.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or to promote harmful or illegal fishing or marine activities.
- Attempt to reverse engineer, decompile, or modify the App.
- Share account credentials or impersonate others.
- Upload content that is abusive, harassing, or violates rights of others.
- Use the App to provide professional navigation, safety, legal, or fishing advice to others.
6. Responsibility & Outcomes
- You acknowledge that marine life encounters and fishing results vary; the App provides logging and memory tools, not guarantees.
- Shelly offers tools and organization; your decisions, catches, sightings, and outcomes remain your own responsibility.
7. User-Generated Content
- You retain ownership of your logs, photos, notes, and records.
- By using the App, you grant Shelly a limited license to store and display your content solely to provide the service.
- We reserve the right to remove content that violates these terms or is harmful to the community.
8. Subscriptions & Payments
- Premium features (e.g., advanced insights, extra cloud storage) may require a subscription.
- Subscriptions auto‑renew unless canceled at least 24 hours before the renewal date.
- Refunds are subject to Google Play Store policies.
9. Intellectual Property
- The App, including code, design, graphics, and original content, is owned by Shelly team.
- Your personal data remains your property.
- You may not reproduce, distribute, or create derivative works from App content without permission.
10. Third-Party Services
The App may use third‑party services (e.g., analytics, cloud storage, sign-in). Use of those services is subject to their respective terms.
11. Disclaimer of Warranties
The App is provided "AS IS" without warranties of any kind. We do not guarantee that use of the App will lead to specific marine life, fishing, or memory outcomes.
12. Limitation of Liability
To the maximum extent permitted by law, Shelly team shall not be liable for any indirect, incidental, or consequential damages, including data loss, missed catches, or safety incidents, arising from use of the App.
13. Indemnification
You agree to indemnify and hold harmless Shelly team from any claims resulting from your misuse of the App or violation of these Terms.
14. Changes to Terms
We may update these Terms periodically. Continued use after changes indicates acceptance.
15. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms.
16. Governing Law
These Terms are governed by applicable laws without regard to conflict of law principles.
